What SB1340 Does for the Driving Public in Arizona NO TOLL ROADS

This Bill has been proposed by Senator Juan Mendez for the last 6 or 7 years and 2023 might
be the year that Bill gets made into law. Arizona Rules Statute section 28-7705 and 28-6803
speak to the Public-Private Partnership Agreement.
First Senate reading was on 2/6/23. The second Senate Reading was on 2/9/23. Both readings
produced a vote to move it through the Senate. The Senate Majority Caucus voted in favor of
the Bill and the Senate Minority Caucus voted in favor of the Bill on 2/21/23. The Senate
Consent Calendar voted no objections to the Bill. A Third Senate Reading also passed the Bill
and it was transmitted to the House for consideration and votes on SB1340.
The House held a First Reading of the Bill on 3/23/23 and then the Bill went to the TI or
Transportation and Infrastructure Committee which voted in favor of the Bill. The House
Second reading resulted in favor of the Bill on 3/27/23.
The COW Consent Calendar or Council of the Whole House voted no objections about the Bill
on 4/4/23. Also, on that same 4/4/23, the House Majority Caucus and the House Minority
Caucus voted in favor of the Bill. On 4/11/2023, the House Council of the Whole House gave the
Bill a Due Pass as Amended vote to continue the way to eventually become Law, if it is signed
by the Governor. At this point in time, the SB1340 would be sent back to the Senate for a final
review and vote before it could be sent to the Governor. We have about three weeks for that to
happen.
The highway department may not enter into an agreement that allows the conversion of
an existing publicly funded or maintained street or highway to a TOLL ROAD, including a
conversion for the purpose of implementing a variety of traffic management strategies listed
in subsection A. Paragraph 15, subdivision (e) of this section.

If it goes on to the Governor and if she signs her approval, this change in the law will prohibit
the conversion of tax payer funded highways into Toll Roads in AZ

February 2023 Legislative Report

As we enter the year 2023, there will be many House Bills and Senate Bills that will be
discussed and voted on with the intension of making them part of the Arizona Law. Let me start
by displaying what may come up this year so far. Updates will be made and listed on our web
site for everyone to read. As of 1/8/2023, there are 18 House Bills and 31 Senate Bills to
consider. I will restrict my report to Transportation issues and Bills that will affect our Hobby.

HOUSE BILLS:
HB2013: Transportation tax; deposit regional fund. Right now reading this Bill I am wary of the
fact that our new Governor last year tried to have a Bill passed that would raise a separate fuel
excise tax for each of our Arizona Counties. The wording of the Bill says “ not more than 20% of
the Transaction Privilege tax to each person engaging or continuing in the county in a business
taxed. My opinion is if all businesses are to pay this new tax, then it will probably result in the
additional price increase to the consumer of electricity and natural gas. This Bill may be DOA,
no votes, no readings at committees as of 2/19/23.

HB2079: State route 90 extension, appropriating monies. The department of transportation
shall extend state route I-10 north to Aviation drive at a projected cost of $40,000,000. This
road is located a few miles west the Benson exit. There have been no committee meetings as of
2/19/23.

HB2097: Appropriating monies to the Department of Transportation, a sum of $18,400,000 for
improvements State Route 89, including construction of a roundabout between Road 3 North
and Road 5 North. This money may be spent only when the town of Chino Valley demonstrates
to the DOT that the town has a commitment of al least $2,045,000 in matching monies of
grants, gifts, and donations from sources other than this state for the project. No committee
meetings as of 2/19/23.

HB2098: Appropriation for the Clarkdale Bridge. The sum of $6,321,360 is appropriated from
the state general fund to distribute to the town of Clarksdale to replace the current bridge over
Bitter Creek with a bridge suitable for vehicular traffic and to convert the current bridge for
pedestrians and bicycle traffic. No committee meetings, no votes as of 2/19/23

HB2107: the sum of $3,000,000 is appropriated from the state general fund to the DOT for
improvements to the interchange at State Route 303 and US Route 60. There has been a TI and
an APPROP meeting in JAN & FEB with a vote for Due Process recorded as of 2/19/23.

HB2241: electric vehicles charging pilot program, a two-year electric vehicle-ready homes pilot
program. No committee meetings or readings or votes have been held as of 2/19/23.HB2097: Appropriating monies to the Department of Transportation, a sum of $18,400,000 for

HB2285: appropriating monies to the DOT from the state general fund to distribute
$22,600,000 to the city of Buckeye to improve Jackrabbit Trail between Thomas Road and
McDowell Road. The Legislature intends that the city of Buckeye contribute $2,500,000. A TI
and APPROP committee meeting held in FEB resulted in A Due Pass Amended/Strike-everything
vote was completed on 2/15/23.

HB2299: appropriation of $32,100,000 to Pinal County for design, right of way and construction
costs for the Hunt Highway. No Committee meetings or votes have been held as of 2/19/23.
HB2300: the sum of $52,000,000 to Pinal County for design, right of way and construction cost
for the Central Arizona Parkway project. No Committee meetings/votes have been held as of
2/19/23.

HB2449: the sum of $9,700,000 is appropriated from the state general fund to the DOT to
distribute to Pinal County for engineering and design of the West Pinal Parkway East-West
Corridor. A TI and APPROP Committee meetings/votes were held in FEB with a DUE Pass result.

HB2453: the sum of $360,000,000 is given to DOT to widen I-10 between Chandler and Casa
Grande. No Committee meetings/ votes have been held as of 2/19/23.

HB2527: transportation tax, Maricopa County; election. No Committee meetings have been
held. This Bill is 27 pages long with numerous additions and strike outs of language and
paragraphs before any committee looks at the Bill. Sorry, I don’t understand what this bill is
trying to achieve

HB2532: appropriation; State Route 87. There have been no Committee meetings or votes held
as of 2/19/23.

HB2604: licenses; not proof of citizenship. A SSN or tax payer ID number is required to apply
for a drivers license. No committee assignments or votes or meetings have been held but the
legislature is bent to approve this bill.

HB2674: more information is required before I can speak to this bill.

HB2707: motor fuel tax suspension, may not be impose between 31 OCT 2022 and 31 OCT
2024. No committee assignments, votes have been held.

SENATE BILLS:

SB1535 for HB2582: transportation; 2023-2024. After the APPOP and RULES Committees
voted on 2/1/23 and 2/6/23 with respective votes of DUE PASS and CP. the House COW voted
this bill a Due Pass action. This bill is concerned with MVD wait times, third party electronic
service party share of fees.

SB1003: Failure to stop or provide driver license or evidence of identity; violation classification
as a Class 2 misdemeanor. I think I have seen this Bill for several years brought each year with
the result being, nobody wants to even read this let alone put it to a vote. This Bill may bear
watching in the future. No action so far as of 19 FEB 2023.

SB1065: appropriation; widening I-10 between Chandler and Casa Grande. First and Second
Reading were held in JAN and the Majority and the Minority Caucus voted Yes on this Bill on
2/14/23.

SB1312: vehicle mileage; tracking; tax; prohibition. The TAT Committee voted a DUE PASS on
1/30/23 and the RULES Committee voted PFC (proper for consideration). The Senate Majority
and the Senate Minority Caucus voted to Pass on 2/14/23. On 2/16/23, the Senate COW voted
to pass and on 2/16/23 the Senate Third voted pass. The Bill was transmitted to the House on
2/16/23.

SB1340: Toll roads; conversion; prohibition. At the TAT Committee meeting on 2/13/23 and the
Committee voted this Bill a Due Pass to continue in the Senate. The Senate Rules Committee
has not yet held a meeting on this Bill.

SB1505: election; Maricopa transportation excise tax. No committee meetings or votes
since2/2/23. No tax is presented this Bill is for allotting existing transportation funds as new
roads are proposed and built.

We are up to 809 House Bills have been submitted for acceptance and 719 Senate Bills to be
considered as of 12 February 2023. The House and the Senate have been very busy creating
new bills for the year.

I would like to shorten this listing of bills under consideration particularly the appropriation

Legislative report SEPT 2022

SB 1109 Toll Roads; conversion; prohibitions. The Second Senate Reading of this Bill was
on 1/11/2022 and it was held in Committees. This the Bill the AAHC has been fighting for almost
five years and it still gets ignored. Senator Mendez continues to bring this Bill up each year that
he is in the Senate.

HB 2872 in place of SB 1739 Signed by the Governor on 6/28/2022. AZ Fleet Management. This
Bill accounts for the money raised by the State Court system in determining what State gets the
money and how much. Left over funds do not revert to the State General Fund, this money is
retained by the state agency for use in the future.

Senate Bills:

SB 1206 License Plate Design and Color. Signed by the Governor on 3/25/2022. Not much to
say, a boiler plate rule as to how our license plates look.

SB 1154 Transportation Electrification study Committee. Held in the House until 6/23/2022. No
further action.

SB 1152 Zero Emission vehicles; plans. Held in the House on 3/10/2022. No further action on
this Bill.

SB 1150 Electric vehicles; pilot program; appropriations. On the Second Senate Reading on
1/13/2022 this Bill was held in Committees. No further action on this Bill.

SB 1148 Vehicle Sale Price; VLT. Transmitted to the House on 3/15/2022 with a First House
Reading on 6/23/2022 and no further action on this Bill.

on 1/11/2022 and it was held in Committees. This the Bill the AAHC has been fighting for almost
five years and it still gets ignored. Senator Mendez continues to bring this Bill up each year that
he is in the Senate.

Nothing has changed, nothing has been done that the AAHC has been looking for to happen.
“United we drive, divided we park” Let’s hope that 2023 is better for the Arizona driving
public.
